BOOKING CONDITIONS - WENGEN
1) Conclusion of the contract
The contract begins with the return of the signed booking confirmation (two corresponding professed intentions). The reservation however is only than guaranteed and the contract final once the flat rate is paid in full. If the flat rate is not paid completely the Wengen property managment does not have to fulfil its obligations.
2) Payment
After the contract is concluded a deposit of 50% is payable within a stipulated period (booking confirmation). The full amount is due 21 days prior to arrival. Short-term bookings must be paid before or on the day of arrival or the latest on the following working day. Without full payment the client has no claim and Wengen property managment respectively the house owner is under no obligation.
3) Holiday flat
The holiday flat booked by the client is not property of Wengen property managment. Holiday flats are only mediated and looked after by Wengen property managment. Wengen property managment has the right by the owner to act in their own name but on the owner's account. Wengen property managment will forward to the owner the rent they are entitled to. The holiday flat may only be occupied with the number of people stated in the description or contract.
4) Obligations
The extent of the contractual obligations result exclusively out of the obligation description by Wengen property managment which is included in the booking confirmation.Contract changes on your side, which change the contractual obligations, need a particular confirmation by Wengen property managment.
5) Client's withdrawal
The client can withdraw his contract at any time with a written explanation to Wengen property managment up to the beginning of his stay. If a client withdraws from his contract or does not take up his stay article 1 of the Swiss rent law applies.
Cancellation policy
1- Up to 90 days prior to arrival date: 15% of the rent or at least SFr 125.--
2- 89th up to 35th day prior to arrival: 25% of the rent or at least SFr. 125.-
3- 34th day to 1 day prior to arrival: 80% of the rent
4- On the day of arrival or no-show: 100% of the rent
5) Change in reservation By request of the client Wengen property managment does change bookings whenever possible if informed early
6) Unclaimed obligations If a client, for Wengen property managment unjustified reasons, does not claim obligations he is not entitled to a proportional reimbursement
7) Withdrawal and notice by Wengen property managment In the following cases Wengen property managment can withdraw from a contract before or after commencement of the stay.
Without keeping the period of notice:
If a client or member of his party does not treat the holiday flat/chalet carefully in spite of being cautioned by Wengen property managment or the owner or behaves contrary to the terms of the contract an immediate termination is justified.
Up to 4 weeks prior to arrival:
If it is not reasonable for Wengen property managment after doing everything within its power to provide the holiday flat/chalet because the owner could not keep his side of the contract due to unforeseen circumstances. However this right to withdraw only applies if Wengen property managment is not responsible for the circumstances leading to it and if Wengen property managment can proof the circumstances leading to the withdrawal and if Wengen property managment has offered a comparable accommodation. If the client does not accept the offer Wengen property managment can use its right to withdraw. The client will be reimbursed if the situation should arise.
After cautioning and setting a period:
If the client does not follow the request for payment against the terms of payment Wengen property managment will send him a caution stating a deadline for the payment with the threat of withdrawal.
8.) Withdrawal of a contract due to unforeseen circumstances:
If unforeseen acts of God (e.g. avalanche danger) make a stay difficult, dangerous or spoil it Wengen property managment as well as the client can only then withdraw from the contract if the holiday flat/chalet is in the officially announced danger zone. Should the holiday flat/chalet not be in the danger zone and the client terminates the contract, than Wengen property managment can request an appropriate compensation for already produced or for ending the stay necessary obligations.
Due to illness:
Costs resulting from illness during the stay are to be covered by the client as well as expenses for a possible special transport home if necessary.If a client's state of health gives reason to concern Wengen property managment highly recommends checking with a doctor before the booking.
Insurance
The flat rate mentioned in the booking confirmation already includes an obligatory cancellation insurance calculated with 3.5% of the rent. In case you already have a private insurance covering a cancellation or withdrawal on your side please inform us in time, after receiving the booking confirmation.
You do not need to be insured twice however you should have one for your own protection.
9.) Special conditions:

b. ) Wengen property managment has no obligations of the flat rate is not paid in full.
c. ) These specific conditions are for "No smoking" and "No Animal or no Pets" apartments only :
Renters are not permitted to smoke cigarettes, cigars, pipes, or any other smoking materials within the apartment at any time. Animals or pets of any kind are not permitted within the apartment at any time.
If a tenant should break this no smoking or no animal condition, the tenant herewith agree, to pay for any and all expenses to rid the apartment of any and all traces of animal or smoking material residues or smells, or damage of the apartment or apartment furnishings.
