The following conditions establish the rules on which basis The European vendor accepts reservations for renting the lodgings described in the present catalogue. Please note that in the following conditions with the word "client" is intended the person on which name the reservation has been made, and it includes the persons on which behalf the reservation has been made.
1) RENT - PRICES.
The rent is made at the daily, weekly or monthly prices indicated in the enclosed price list. Prices do not include: a) Weekly cleaning expenses (optional) which cost L. 30.000 a week. b) Final cleaning expenses (mandatory), which cost L. 50.000 - 70.000.
2) LEAST RENTAL PERIOD.
The least rental period is one week. The stay can be initiated any day of the week.
3) RESERVATION.
The lodging is considered as booked in the act of paying the 50% of the rental price. Booking via phone, fax or e-mail will be considered as valid up to the third day from the reservation, which is the final term to make the payment of the 30% of the rental price, or the reservation will be cancelled.
4) PAYMENT PROCEDURES.
The payment is made with advance deposits of monthly or weekly dues, or of the whole amount due when the rental period is less than one week.
5) DEPOSIT.
It is generally requested a security deposit, to cover the non-fulfillment of the contract by the lessee or damages incurred to the property or it's contents during the rental period. The amount of the deposit must be paid on arrival, and it corresponds to 50% of the total monthly amount or to 30% of the total amount if the duration of the stay is less than a month.
6) CANCELLATION CHARGES.
In the case of cancellation from the lessee, the charges will be calculated as follows:
- cancellation communicated by 45 days from the arrival: 15% of the total amount
- cancellation communicated between 44 and 30 days prior the arrival: 30% of the total amount
- cancellation communicated between 29 and 7 days prior the arrival: 80% of the total amount
- cancellation communicated less than 7 days from the arrival: 100% of the total amount.
7) CHANGE OF PROPERTY.
In the event that the reserved property is no longer available for the dates booked, for reasons beyond control of The European vendor, The European vendor reserves the right to allocate an alternative property, in a different location with similar characteristics of the original property booked.
8) GAS AND ELECTRICITY EXPENSES.
Gas and electricity expenses for the domestic use (including heating and air conditioning)are included in the rental price, when not otherwise specified. Nevertheless, when the consumptionexceeds the amount of EUR 10.50 per week, the excess amount will be charged to the client, beinghigher than the weekly average. In the event that these bills are not paid prior to departure,The European vendor will charge the client the amount due and an extra bill of 15 Euro asreimbursement of administrative expenses.
9) HEATING AND TELEPHONE BILL.
For lodgings with centralized heating, the heatingbill is always included in the rental price. In the other cases what is stated in clause 8 is valid.The lodgings are usually provided with a telephone. If a phone is available to make local,national or international calls, the respective bills must be paid by the clients prior to departure.In the event these bills are not paid prior to departure, The European vendor will charge the client theamount due and an extra bill of 15 Euro as reimbursement of administrative expenses.
10) PETS.
Pets are admitted upon agreement of the European vendor and consent of the real estate's owner.When not otherwise specified by the lodging description, the client will be charged the amount of30 Euro per animal a week, to be paid together with the settlement.
11) ARRIVAL AND DEPARTURE SCHEDULE.
The check-in is generally between 4PM and 7PM. (early check-in ispossible if the apartment is ready)
For check-in on Sunday, public holiday, after and before working hours there is an extra fee of:
- Euro 35,00 for arrivals on Sunday or public holiday, between 9AM and 10PM
- Euro 35,00 for arrivals between 7PM and 10PM or between 7AM and 9AM.
- Euro 60,00 for arrivals between 10PM and 7AM every day.
- Euro 60,00 for arrivals on Christmas, Easter and New Year.
Departure: The apartment be vacated by 12 noon on the departure day.
12) RESPONSIBILITIES OF THECLIENT.
In the case that the client or a client's visitor causes damages to the lodging or its contents, the client is responsible for the damages. The respective expenses will be charged to the client on departure time or deducted from the deposit.
13) NUMBER OF GUESTS.
It is never permitted the lodging of guests exceeding the number stated in the catalogue, including babies or children, if not agreed in advance with The European vendor. The owner has the right of denying the access to the lodging if these conditions are not kept. Only the persons whose name is specified in the reservation are allowed to the lodging. Any substitution of people during the rental period is forbidden if not agreed in advance with The European vendor It is forbidden to park caravan and trailers, and inhabiting them, or to camp, in the lodging ground.
14) RESPONSIBILITIES OF The European vendor
The descriptions contained in the catalogue are correct and written in good faith. Consequently, The European vendor declines any responsibility of possible changes made without being notified, unless there is the impossibility of a total or partial fulfillment of the contract, or that the client is not interested in the partial fulfillment of the contract. If, for any reasons beyond control of The European vendor it is forced to cancel the client's reservation of the lodging, The European vendor has the right to assign, upon mutual agreement, a similar lodging. If the price of the alternative lodging is lower, the difference will be reimbursed to the client. If the price would be higher, the difference will be paid by the client. In the case an agreement cannot be reached, the two contracting parties have the right to resolve the contract. The European vendor will reimburse to the client the total amount deposited to The European vendor excluded any additional reimbursement. The European vendor declines any responsibility caused to the client by events related in any way to the use of the apartment, included physical and/or material damages or loss caused by fire, theft or other criminal activities.
15) EXTERNAL MAINTENANCE.
If necessary, the owner or his/her agent, has the right of access to carry out the indispensable maintenance operations (garden, swimming poll, etc...)
16) PRICE INCREASE.
If, for any reasons independent of The European vendor's willing, the cost of the apartment should be increased of more that 10%, the client has the right to cancel the reservation and receiving his/her money back, on condition that such request would arrive to The European vendor within 14 days from its communication that notifies a price increase.
17) JURISDICTION.
In the case of a controversy regarding reservation or rent, only Italian law applies and the Tribunal of Pome is competent. The signature of the reservation implies the knowledge of the General Rental Conditions. If some conditions of the present contract were or will become not valid, or if the present contract would show an omitance, the validity of the remaining conditions cannot be appealed.
18) PROTECTION OF PERSONAL DATA.
In compliance with the law 675/96 on privacy protection and personal data treatment, The European vendor, with offices in Rome, informs that your personal data will be only treated for finalities connected or instrumental to its own activity, that is:
- a) finality a1) stipulation of renting contracts, through the reservation procedure; execution and correct fulfillment of the relative contractual obligations; handling and solution of legal and /or jurisdictional controversies; a2) information about our tourist programs promotions; mailing of catalogues; gathering of data on The European vendor customers' satisfaction.
- b) utilization the confer of data is required for the fulfillment of the contractual, administrative and fiscal obligations provided by law.
- c) consequences the lack of consensus to the data treatment referred at previous point a1) has a consequence the impossibility by The European vendor to put into execution the contractual obligations. As far as the previous point a2) is concerned, the refusal to the data treatment doesn't give raise to any effect.
- d) procedure The personal data treatment will be carried out with the help of modern information systems and by specialized personnel. Your data will not be released and/or given to third parties except in compliance with contractual and/or legal obligations.
