1. Contract
1. These booking conditions confirm the terms of contract which automatically come into force on payment of the deposit. 2. Reservation, Confirmation and Payment
You have made your reservation online and received a confirmation with dates and price of the reserved property. Any modifications are confirmed in this document, which forms the basis of our contract with you and should therefore be checked carefully. To accept the booking, a deposit of 30% of the total amount has to be paid within 14 days. Payments can be made by personal check, VISA or MasterCard. If no deposit is received, we reserve the right to void the tentative reservation after a reasonable waiting period. For last minute reservations made 29 days or less before the planned arrival date, payment in full is due immediately. In this case the contract conditions come into force once the final payment has been received. The balance of the price of your vacation accommodation must be paid at least six weeks before departure date. Only one invoice is sent and we recommend that you put a reminder of the due date for final payment in your calendar. If the balance is not paid on time, we will try to contact you but reserve the right to cancel your reservation, retain the deposit and apply cancellation charges as indicated below. A vacation voucher including the rental address, the key-holder's name, phone number, address and local directions will be sent to you after receipt of the final balance. This voucher should be handed to the local key-holder or the property manager on arrival. If you are departing the US well in advance of your check-in date, please request your voucher(s) to be sent early. Any extra requests can only be guaranteed if confirmed in writing by the property management agency. 3. Prices and Periods
Prices are quoted per home per week (not per person) within the price period shown. North American travelers should note that the dates for the different price periods may be indicated in European fashion: first the day of the month, then the month (for example 14.12 = Dec. 14). In high season bookings are normally from Saturday to Saturday. Sometimes other restrictions apply over Christmas and New Year. During shoulder and low season, other arrival and departure dates may be possible. Short breaks (3+ nights) are also available in many properties. If your vacation falls across two different price periods, you will be charged pro rata for the number of days in each period. Prices generally include the power costs, final cleaning, bed linen and local tourist tax unless indicated as an extra charge in the price list or on your confirmation. Where final cleaning is not included and the amount is stated in the price list, this will be added to your invoice. Any other additional services, such as extra cleaning, firewood, garage, telephone, etc. are not included and have to be paid locally. For rental properties indicating that linens and/or towels have to be brought, it means they cannot be rented or obtained locally. Self-catering accommodation often requires that you have to supply all items necessary for daily living. 4. Your Holiday Accommodation
The rental accommodation is usually privately owned and we act as agents on behalf of the proprietor. We always send the description with your confirmation. We would draw your attention to the following points to help you understand what to expect in your vacation home: Our vacation homes are furnished by the owners to their individual wishes, taste and local standard. Some are luxurious, many very comfortable, others more moderate and some rather basic. Items such as dishes, cutlery and bedding are always provided, but coffee makers, teapots or toasters cannot automatically be expected. Since many homes in Europe do not have ovens, we always mention it in the description when there is one available. If "oven" is not mentioned, then there will only be a hob or hot plates. All homes are equipped with a refrigerator (usually not as large as Americans may expect). Double beds are always provided where the description states "1 room with double bed"; "1 double bedroom" means 2 twin beds side by side or twin mattresses on a double base. Where "divan" is mentioned, it means a sleeper sofa or similar seating convertible to sleep in the evening. Please bear in mind that these additional sleeping possibilities are often not as comfortable as regular beds. If a home offers extra amenities like TV, phone, air-conditioning, dishwasher etc., these will be mentioned in the description. If they are not mentioned, the property does not include them. Regrettably, we cannot always answer specific questions about all furnishing details, availability of appliances or exact size of rooms if not mentioned in the property description; neither can we usually provide detailed floor plans. 5. Changes in Conditions or Prices
We have taken great care to ensure the details in this brochure are correct. If we should discover any changes or errors, you will be advised without delay and normally at the time of invoice before you accept the accommodation. If we discover any changes after you have confirmed the booking, we will of course advise you immediately and offer you the option to accept the change or an alternative vacation home of equal value (if available) or a full refund of all monies paid without further compensation (see point 8). The prices contained on our website and in our 2008 catalogs are based on exchange rates prevailing on October 01, 2007. While we reserve the right to increase or decrease the prices at any time before you book, once your booking is confirmed the price of your reservation is fully guaranteed and will not be subject to any surcharges. In return for this commitment, no refunds will be made for any exchange rate movements or cost adjustments that would otherwise reduce the rental cost. We cannot be held responsible for price discrepancies due to typographical errors. We reserve the right to impose any taxes or other charges, which may be implemented by the Government or other regulatory body, which were unknown at time of publishing this price list. 6. Arrival and Departure, Curtailing or Extending your stay
You should arrive between 4.00 pm and 7.00 pm on the day of commencement of your booking and vacate before 10.00 am on the day of departure unless an alternative schedule is specified on your voucher. Please contact the key-holder by telephone if you are delayed or request an exceptional earlier or later check-in. If you are unable to take occupation on the day and time reserved due to delay, illness, personal reasons etc. no refund can be made. Similarly, if you have to cut your vacation short for any reason, no refund can be made for unused days. If you would like to extend your stay, please contact your agent or the local service office; they will tell you immediately whether this is possible. 7. Changes or Cancellations by you
If you wish to change any accommodation arrangement we will endeavor to do so. There will be a charge of $30.00 for every change we are able to confirm. If, however, you request a change of accommodation 42 days or less before arrival date this will be treated as a cancellation and the following cancellation charges will be due. Should you have to cancel your accommodation, you will incur the following cancellation charges: - Cancellations made 43 days or more before arrival = 10% of rental cost. - Cancellations made 42 days to 29 days before arrival = 50% of rental cost. - Cancellation made 28 days or less prior date of arrival = 100% of rental cost. The $30 booking fee and cancellation guarantee (if taken) are non-refundable. All cancellations must be confirmed in writing. We recommend you take vacation insurance to cover against unavoidable cancellation. We can offer you our Cancellation Guarantee for medical emergencies. It costs 4% of the rental fee and covers you against cancellation charges on the accommodation only if you are forced to cancel within the penalty period due to illness or death of any member of the traveling party or close relatives. You must submit a medical or death certificate to make a claim on this cancellation guarantee. Preexisting medical conditions or pregnancy known at the time of booking will not be covered. 8. Changes or Cancellation by us
It is unlikely that we will have to make changes to your reservation. If we are forced to do so, we will advise you at the earliest possible date and will offer you the option of accepting the change or an alternative accommodation of the same value (if available) or a full refund of all monies paid without further compensation. If any change is advised less than 4 weeks before departure we will also offer compensation of $50 per booking or a maximum of 10% if the total value of the booking is less than $500 unless the change is due to war, riot, industrial dispute, natural disaster, fire or any other reason outside our control amounting to an act of God. 9. Your Liability
You have to pay a security deposit on arrival of approximately $300 in local currency (more can be requested for large or luxurious properties). This can be paid in cash or by traveler's checks or, in some cases, by credit card. The local key-holder is not obliged to hand the keys over until the security deposit has been paid. The deposit will be refunded on departure directly by the local key-holder after deduction of any extra charges or damages. Please settle your account before you check out; the US reservations office may not always be able to collect outstanding deposit refunds retroactively. You must take care of the property and contents and respect the local rules. If you break or damage anything in the vacation home you must advise the key-holder or local office immediately. You and your party will be responsible for any breakage or damage made, unless you can prove it was not your responsibility, and will have to pay for replacements or repairs. You must leave the property in good order and wash and put away all kitchen utensils before your departure. The final cleaning by a third party is usually included in the rental price or may be arranged by paying a local extra charge. Occupation of the property is strictly limited to the number of people indicated on the voucher. The key-holder has the right to refuse entry to extra persons or charge a supplement. 10. Complaints
If you should have a problem during your vacation, you must inform the local key-holder or office immediately who will endeavor to put things right. In serious cases you should call the office you booked through. If your complaint cannot be completely resolved locally, you must confirm your complaint in writing to the office you booked through within 28 days of vacating the accommodation. It is therefore a condition of this contract that you communicate any problem to the local key-holder or booking office whilst on location. If you fail to follow this simple and reasonable procedure, we cannot accept responsibility as we have been deprived of the opportunity to investigate and rectify the problem. 11. Our Liability
We accept responsibility to ensure that the vacation accommodation, which you booked with us, is supplied as confirmed and that the services offered reach a reasonable standard. We cannot guarantee resort facilities will be open in the low season. Swimming pools are normally open only during the main season. If any part of your vacation accommodation is not provided as promised, we will pay you appropriate compensation if this has affected the enjoyment of your vacation. Unfortunately we cannot accept responsibility for any interruption in services, such as gas, electricity and water, over which we have no direct control. In the event of death, bodily injury or illness we can only accept responsibility, if the occurrence results from the negligent acts and/or omissions of our own employees or agents, suppliers and sub-contractors whilst acting in the course of their employment. Use of swimming pool, children's play areas, sports facilities (e.g. tennis, football pitches, training facilities): All of these activities can be dangerous if not used properly, so please take care and be safe. If the client or any member of the party suffers death, illness or injury whilst on vacation arising out of activity which does not form part of the vacation arrangement contracted through us, we shall, at our discretion, offer advice, guidance and assistance to help in resolving any claim you may have against a third party, provided we are advised of the incident within 90 days of the occurrence. 12. Indemnity
You agree to indemnify, defend, and hold us and our affiliates, successors, assigns, partners, shareholders, members, directors, officers, employees and agents harmless against any and all injuries, claims, losses, damages, costs, expenses, penalties and other liabilities to any person or property (including without limitation, all reasonable attorney's and court fees, costs and other litigation, settlement and investigation expenses) of any nature, kind or description (the "Liabilities") made. Incurred or sustained by you or your guest or invitees, directly or indirectly arising out of, caused by, in connection with, related to our resulting from your rental of the vacation home under this agreement, except to the extend such Liabilities are caused by our gross negligence or willful misconduct. The provisions of this section shall survive any termination or earlier expiration of our agreement and shall be binding upon the parties hereto and their respective heirs, legal representatives, successors and assigns. 13. Limitation of Liability
Notwithstanding any other provision in this agreement, we are not liable to you for any special, consequential, exemplary or incidental damages of any kind whether arising in contract, tort, or otherwise. Our liability to you for any damages or injury whatsoever shall be limited to the amount of your rental cost. 14 Governing Law
This agreement will be governed by the laws of the State of Florida without giving effect to choice of law provisions.
